Booking and Use of Property Terms And Conditions This is not a Rental Agreement. This is a Use Agreement between you and the owner of the property, who has granted you permission to stay on the property, for the time specified in this agreement, as his GUEST. If Guest cancels, no refund will be issued If Owner cancels, full refund of guest’s payments will be issued. When a Cash Security Deposit is made it will be returned 7 business days after the check out date unless the property is not returned in the same condition it was received or any balances are unpaid or the Terms & Conditions herein are not followed. Housekeeping if agreed to be paid by Guest and any additional costs for Cable Movie Fees, Cigarette Cleanup, Rekeying Locks, Citations Fees, Replacing any Missing Items and Repair any Damage Property. After all is restored to its original condition the remaining balance if any, will be sent back to you. The guests and only the guests as listed in the agreement shall have the use of the property and agree to use the property for residential purposes only and not to ASSEMBLE PEOPLE for any reason. And in no event shall the property be utilized, in part or in whole, for any Commercial purposes. If at any time you have not followed this condition of use, You agree to forfeit your security deposit and vacate the property upon demand. And further agree to use the Property in a dignified quiet manner that is respectful of the property, neighbors and neighborhood. And never to be disorderly, boisterous or unlawful. And agree not to have any parties, and to keep the music and talk to an ambient level at all times. City of Miami Beach prohibits private or public nuisances, noise violations, parties that create disturbances of the peace, parking on the street, parking in the right of way, parking on adjacent private properties, or any other acts that may be deemed improper or illegal by local regulatory authorities. Any Citations issued will be paid by the guests plus a $500.00 surcharge to the property owner. No Alterations to the property are allowed unless first agreed upon and written approval is granted by the owner. Guests are responsible for anything missing, broken or damaged during their stay. All amenities are in good working condition at time of check in and must be in the same condition at time of check out. . If any repairs or replacement’s must be made to anything, while the guests are on the property or after the guest have left the property, the guests agree to be responsible for the cost of repair or replacement, which ever the owner deems best and owner will act with due diligence in making the repairs. Front Door Entry Code and Keys to the front door will be provided and the same number of keys must be returned at time of check out, If not, Guests agree to pay up to $200.00 for a rekeying fee. . No Smoking is allowed in the Building and all cigarette ashes and butts will be disposed of properly. If not, the Guests agree to pay up to $200.00 in a cleanup fee. No pets are allowed, unless first agreed upon, a security deposit made and written approval is granted by the owner. On premise parking, for cars only, is available for no more than 4 cars. And the owner reserves the right to 1 space at all times. No oral agreements have been made. This is the entire agreement between the parties, and it may be modified only in writing signed by all parties. Owner shall not be Liable for Personal Injury or Damages or Loss of Guests personal Property for any reason or causes whatsoever. OWNER STRONGLY RECOMMENDS THAT ALL GUESTS SECURE THEIR OWN INSURANCE TO PROTECT THEMSELVES AGAINST ALL OCCURRENCES. Guests, as a material part of the consideration to be rendered to the owner under this agreement, hereby waives all claims against Owner, except for Owner’s negligence, for damages to household furniture, goods and chattels or other property in, upon or about the premises and for injury to persons in or about the premises, from any cause arising at any time and Guests will hold Owner exempt and harmless for any damage or injury to any person, or to the household furniture, goods and chattels or other property, or any person arising from the use of the premises by Guests, or Guests invitees, or arising from the failure of Guests to keep the premises in good condition repair as herein provided. In the event of litigation between any parties hereto, relating to the terms and conditions in this agreement, or the breach thereof, the prevailing party shall be entitled to such reasonable attorney’s fees as may be fixed by the court. Governing Laws This agreement is governed by the State of Florida, Dade County and the City of Miami Beach.
