WHAT TO DO?

Access Passes for use at the WPI tennis, golf and swimming pools (fee and restrictions apply).

If you are like my wife Linda, you could head out to visit one of the ten wineries in Nelson County.....5 are within a 25 minute drive! When Linda prefers to just stay home and relax, I will pick up the ski shuttle at the entrance to the condo so I don't have to drive and park at the slopes. On most other days, you would find me at the tennis courts (indoor or outdoor) just across the street. That's what makes this a great winter as well as summer location for relaxing and/or staying active. And don't worry, there are only eight short stairs to our front door.....no climbing two or three flights here!

This condo is a pleaser for everyone! Don't miss the chance to visit our property....you won't be disappointed!

                    We stayed at the condo for a birthday trip for my husband and father in law. Prior to arriving, Joe worked with us to make sure we had good directions and got in with no confusion. The trip up to the top of the mountain was much steeper than I expected, especially with two travelers afraid of heights, but it was worth the view when we got up there! We loved having a comfortable home to relax in after long days of winery/brewery tours. The home was very clean, comfortable and well stocked with any dishes and linens that we needed. We all agreed that we would stay here again!

                    We were blow away the second we stepped into the condo. The pictures do not do it justice! The view is breathtaking and everything you could want and need for a getaway is right there in the condo. The bed was amazing…we slept like babies. The condo was spotless, very modern and inviting. Joe was a pleasure to work with. We will DEFINATLY be back again! Thank you for everything!

                    What a wonderful place! The pictures do not do it justice. Everything was very clean and neat and the bedding is "to die for"! Very convenient location and easy to get to slopes and restaurants. Our son and his friends particulary enjoyed taking the shuttle to go snowboard. We would not hestitate to recommend this condo. With the two king size bedrooms this would be a great place for 2 couples. Joe was very helpful both on the phone and by email. The rental process was extremely easy and streamlined. Would definitely rent this place again!

                    My family and I have stayed at several properties in the past few years, but this is now my favorite! There are all the amenities that you can imagine. The decor is gorgeous, the beds are super comfy and the deck furniture is perfect for enjoying the view and drinking your morning coffee. The condo was clean as a whistle. We love the Wintergreen/Nellysford area; especially the wineries and brewies, most within a 15 minute drive. We will definitely be back!!

                    We stayed here in October and had a wonderful time. It was just my wife and I and our stay was very relaxing. The place is much larger than the photos are able to show. The place is very quiet and is freshly updated - new wood floors in the living area, granite countertops in the kitchen, bar area, and bathrooms, and new stainless steel appliances (fridge, microwave, ice-maker, wine fridge). There's a huge television in the main room, so I was able to watch football on Sunday in a comfy couch while my wife relaxed in one of the cozy swivel chairs next to the huge windows. Very spacious deck out back with probably the best views of the mountains. Every morning we would wake up and watch the sunrise while drinking fresh coffee from the complimentary Keurig coffee-maker. The bedroom was spacious with a king bed, and the master bath had a great jetted-tub. We enjoyed the area - Devil's Backbone Brewery is at the bottom of the mountain, with Bold Rock Cidery, Wild Wolf Brewery, and Blue Mountain Brewery on the main road up to Wintergreen. Numerous wineries are in the area, and Charlottesville is a short car ride away. We will definitely stay here again, and the property owner was very responsive to us. Highly recommended!

                    Groundhog Day doesn’t just come in February. A groundhog is seen ever day from the picture windows from this Wintergreen condo. The spectacular mountain view at both dawn and sunset is only enhanced by the antics of the very active Phil. Whether sitting inside enjoying the scenery or fully enjoying the view and the crisp mountain air from the deck, it is hard to find a more peaceful setting. If activity is on your agenda, walk across the street. A walking path meanders through the woods and parallels one of many first class golf holes. Also within close proximity of the condo are over 30 tennis courts. When the snow falls, you have a magnificent spot to watch all the activity on the slopes or join in the fun right behind this well situated condo. This two bedroom, two bath condominium is perfect for two or four people. In addition to the two spacious bedrooms, each with a king size bed, the condo offers a completely equipped full kitchen, dining and living areas with a mountain views, and a laundry room. Not that anyone would want to do laundry, with all the amenities Wintergreen offers right out the door. We look forward to another peaceful respite at this getaway!

                  Cancellation policy:

                  Rental Agreement You (the "Renter") are reading this agreement because you are choosing to send a deposit to the one of the Owners, Joseph Thomas Cipolla or Linda Sue Cipolla in exchange for reserving and renting a property with the legal address of 1629 Overlook Condo (also known as 1629 Blue Ridge Drive), Wintergreen, VA. In exchange for the agreed upon monetary sum listed on the invoice associated with making a deposit for the rental of the condo, you affirm having read, understand and agree to the following: Reservation for Rental Deposit Reservations must be guaranteed with a VISA, MasterCard, or Discovery. To confirm your reservation, a deposit equal to one-half the total balance including the security deposit will be required. Balances must be paid in full as indicated on the invoice associated with this rental, 10 days before occupancy can occur. Renters are responsible for any bank fees or service charges not successfully processed or denied by the bank. The bank fee or service charges incurred by the Owner will be deducted from the security deposit when refunded. WE DO NOT ACCEPT E-CHECKS as Renters' encountered problems in the past beyond their control which resulted in a minimum $25 service charge. Cancellation by Renter The Owner will issue a full refund when notice is received in writing from the Renter. This notice must be received more then (30) days in advance of the start of the rental period. Check-in and Check-out Times Check-in is no earlier then 4:00 PM on the first day and check-out is no later then 11:00 AM on the last day. Other times must be confirmed in writing with the Owner. Any unauthorized use of the condo before or after these times will result in an additional charge, unless waived by the Owner, and in writing. Opening and Closing of Condo Directions will be provided to the Renter for turning on and turning off of certain services such as water, electric and beverage center ice maker, upon arrival. The directions will be placed on the kitchen counter in a notebook along with other information pertaining to Wintergreen Resort. A telephone number to contact the Owner will also be listed to facilitate ease in case clarity is needed. Occupancy Occupancy is limited to a maximum of six (6) persons. People other than those in the Renter's party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Renter and subject to termination of this agreement without a prorated refund. Underage Occupants No person under eighteen (18) years of age is allowed to be unaccompanied while at the condo, or permitted to rent the condo. The Renter of the condo must be at least twenty-five (25) years of age, be an occupant during the entire time period, and be responsible for any and all damage and theft related to the condo by visitors or other guests during the rental time period. Misrepresentation of the Renter's age is cause for immediate termination of rental agreement without a prorated refund. Refunds Refunds for cancellations more than 30 days in advance will be 100% of amount paid, minus a $20 administrative charge. Refunds for cancellations between 15 and 30 days in advance will be 50% of total condo rental rate (not including fees). No refunds for cancellations 15 days or less. Non-Smoking Policy This condo is a non-smoking unit. Any charges resulting from deodorizing the property or other smoke related maintenance/damage/fire shall be the financial responsibility of the Renter. This includes but is not limited to false alarms to local fire department or law enforcement agencies. Furthermore, the act of smoking voids any discount rate and said Renter will be financially responsible for all discounted condo revenues. The minimum deodorizing charge is $200. Jetted Tub No persons under the age of eighteen (18) are permitted in the jetted tub at any time without immediate adult supervision. When using the jetted tub, remember there is a certain health risk associated its use. Use at your own risk. Persons consuming alcoholic drinks shall not use the jetted tub. Animals Animals are not permitted in the condo. Violation will result in loss of security deposit ($200) to cover deodorizing and additional cleaning. Renter will also be responsible for all additional damages which will be litigated in Nelson County Courts when not promptly paid to Owner within 21 days. Damage to Condo and Condo Property The Owner reserve the right to charge the Renter the cost of rectifying damage caused by the deliberate, negligent or reckless act of guest to condo property or structure. This includes the loss of use and expenses beyond reasonable wear and tear incurred during occupancy or resulting from the rental. Should this damage be revealed after the Renter has departed during the post-occupancy inspection, the Owner reserves the right to make a charge to the guest’s credit / debit card, or send an invoice for the amount to the registered address. We will however make every effort to rectify any damage internally prior to contracting specialists to make the repairs, and therefore will make every effort to keep any costs that the Renter would incur to a minimum. Wet clothing and shoes should be restricted to the tiled floor at the main enterance to prevent damage to the hardwood floors. Salt, debris and water will cause damage to hardwood floors. Removal/Theft of Condo Property We reserve the right to charge the Renter the cost of replacing any items that are removed from the premises without consent. The charge will be the full replacement amount of the missing item, including any carriage charges. Should the fact that the item is missing come to light after the guest has departed, we reserve the right to make a charge to the guests credit/debit card, or send an invoice for the amount to the Renter. Cleaning Charges and Trash Removal The condo and property will be inspected after the Renter's departure. The Renter is responsible for additional cleaning fees that resulting from above and beyond normal wear and tear. The standard cleaning fee will be $75. Renters who stay beyond one week are responsible for maintaining the condo in the original condition on a weekly basis, unless additional cleaning services are agreed upon in writing. The Owner will provide one cleaning of the condo which will be performed at the end of the rental period. Renter's are responsible for taking trash bags to dumpsters located in the condominium parking lots upon their departure. The Renter will be charged an additional fee of $25.00 when there are more than two (2) trash bags that need to be removed. Cable/Internet /Telephone Due to weather conditions and/or circumstances beyond the control of the user, the cable/internet/telephone connections can not be guaranteed. If this occurred, please use the services located at the Black Bear Café and the Mountain Inn. If these service connections fail, contact the Owner immediately so the appropriate company can be notified. No refund will be provided. Local telephone calls are included with the condo rental. Renters are responsible for any other phone charges incurred during the rental period. Lost or Non-Returned Keys A fee of $20.00 is due for all keys lost or not returned. Keys should be left key deposit box. Use of Walkie-Talkies The Owner may make available the use of walkie-talkies for the Renter's use while up on the mountain. Please return them to the Media Center in the condo before the end or your scheduled stay. Missing walkie-talkies will result in a $100 charge. Batteries not included. Inspection of Property Owner retains the right to inspect the condo if he reasonable believes there is a violation of this agreement or laws. A complaint to the local police for noise protruding outside the rental property may result in the immediate termination of this agreement and immediate eviction without prorated refund. Access Passes The Owner may provided Access Passes issued by Wintergreen Property Investment (WPI) to the Renter. Renter is responsible for returning them at the end of the rental period to the Owner. Failure to do so will result in a $200 fee. Renter is responsible for all fees charged for use of the Access Pass while at Wintergreen Resort and associated properties. Court Fees/Attorney Fees The Renter is responsible for cost incurred by the Owner including and not limited to attorney fees associated with the recovery of financial losses, fees, damages and theft, regardless of whether it is due to intentional, accidental, negligent or omission of behavior. Cancellation of Rental If Wintergreen's roadway is closed from the police building (guardhouse) located near the entrance of the property, preventing access up the mountain, then the owner will be responsible for a refund for that day's charged rate, provided the road closing occurred prior to the scheduled arrival time for the rental period. When possible, the Owner agrees to make a reasonable rebooking of the same condo within two months for any unavailable or unused days. This rebooking will be at comparably posted rates and does not include holiday weekends or special event dates when pricing is posted as higher than the cancelled time period. Exception to this is when the state or local authorities order mandatory evacuation of the Wintergreen Resort properties. Cancellation of the rental of the condo due to conditions beyond the control of Owner, including but not limited to, weather conditions, acts of God, or force majeure, prior to arrival are grounds for a prorated refund for any days the condo is not accessible. Weather conditions include rain, snow, hurricane, tornado warning, blizzard, and fire. Violations/Termination of Agreement Violation of any above section may result in the immediate termination of the agreement and requesting the Renter to immediately evacuate the condo. No refund will be given for any remaining time on the rental. Cancellation Due to Administrative Errors The Owner reserves the right to cancel any reservation if it is discovered that an administrative error has been made in the reservation, prior to the Renter taking occupancy (ie double booking, rate error with online booking system). In this case, the Renter will be given a full refund of any money deposited. Renter Complaints and Privacy Notice Certain websites allow reviews of properties that are unchecked with regard to reasonable sentiment. As such, the Renter agrees that the relationship between you, your guests and the landlord/owner is and shall remain private. The Owner will reasonable be available to address any concerns a Renter may have with the property. Additionally, the Owner will not release the Renter's personal information such as name, address, date of birth and social security number or credit card information, to the public, unless used in pursuit of civil litigation. In exchange, specifically, Renters agrees not to post a review on any website outside VRBO or HomeAway unless solicited in writing by the owner, understanding that even minor unreasonable negative sentiment may unjustly cause thousands of dollars in damages to Owner’s future business. The Renter agrees to pay Owner damages of up to five thousand dollars upon demand by Owner if any review is posted by the Renter or guest that is not requested separately in writing by Owner. No posting of a review is permitted and upon request shall be immediately (within 48 hours) be removed by Renter/guest upon request by Owner to the Renter. This statement shall serve as Renter's full authorization to remove any such review promptly upon request by Owner. Definitions Owner The Owner is the person(s) currently holding the Deed to the property. Renter The Renter will be the person(s) agreeing to the above conditions for renting this condo. "Renter" is interchangeable with the word "you". The Renter accepts responsibility for the actions of any guest or visitors in the enforcement of this agreement. Condo Is interchangeable with condominium. Invoice An electronic document from the VRBO website providing rental information such as first and last date of occupancy, charges, and payment deadlines. This electronic document sent by the Owner precedes the collection of deposits from the Renter. The Renter can only be quoted a price through the VRBO website which maintains historical electronic communications. Reservation Manager System Is the electronic clearing house for payments made with VRBO.
