Cancellation policy:
SHORT TERM RENTAL AGREEMENT This Short Term Rental Agreement (the “Agreement”) is made by and between Diane Bourgault (“Property Manager”) and (“Guest”) as of the date set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. Property. The Property is located at: 2638 Chairlift Road, West Vancouver, BC, V7S 3E5, Canada The Property is furnished and includes linens and towels, satellite TV, Wifi and local calls. 2. Rental Party: The rental party shall consist of Guest and the following persons: 3. Maximum Occupancy: The maximum number of guests is limited to 10 persons. 4. Term of the Lease. The lease begins at 3:00 pm on and ends at 11:00 am on (the “Occupancy Period”). 5. Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the Property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the Property. 6. Access: Guest shall allow Property Manager access to the Property for purposes of repair if necessary. 7. Rental Rate and Fees a. Deposit: Either a deposit of $500.00 is due within 7 days of signing this rental agreement or else purchase of the Insurance offered by VRBO at the time of booking the Property. The deposit is for security and shall be refunded within 5 days of the Checkout Date provided no deductions are made due to: i. damage to the Property or furnishings; ii. long distance charges on the home phone iii. dirt or other mess requiring excessive cleaning; or iv. any other cost incurred by Property Manager due to Guest’s stay. If the premises appear dirty or damaged upon Check-in, Guest shall inform Property Manager immediately. b. Rental Rate. Payment in full of the following fees shall be due within 45 days of the Check-in Date: Weekly rate $3000. Nightly $475.00 Cleaning fee $ 300.00 8. Cancellation Policy: If Guest wishes to cancel her reservation, the deposit will be refunded as follows: 100% if cancelled 45 days prior to the Check-in Date Within 45 days of rental start date all monies paid are non-refundable. Property Manager recommends that Guest obtain cancellation insurance 9. Booking Confirmation and Cancellation: Property Manager will confirm booking in writing upon receipt of a signed rental agreement and payment as set out above. Once confirmed by Property Manager a contract binding all parties shall be in effect subject to the following: Should Property Manager be forced to cancel a confirmed booking for any reason before the occupancy period commences, all monies paid by the Guest shall be refunded in full to the Guest by Property Manager and this Agreement shall be deemed to be null and void. Should the Guest wish the Property Manager to do so, Property Manager will endeavor to find alternative accommodation, but the Property Manager shall not be liable to the guest in any way, other than as outlined in this paragraph. 10. Payment: Acceptable payment methods are personal check, visa, mastercard or paypal The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the signatures set forth below. The Guest shall not, without the written permission of the Property Manager permit or allow any persons other than those specified on this rental agreement as members of the Guest’s Party, to stay overnight on the Property. 3. The Guest shall not assign this rental agreement nor her rights hereunder to another person without Property Manager’s prior written authorization. 4. The Guest agrees to vacate the Property on the date and at the time set forth in this rental agreement and further agrees to leave the Property in the same condition as it was found at the beginning of the occupancy period. 5. The Property Manager is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Property Manager is not responsible for the loss of personal belongings or valuables of the Guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 6. The Guest accepts responsibility for any damage, breakages, missing items, loss or injury to the property caused by the Guest or any of the Guest’s Party. The Guest further accepts responsibility for the cost of long distance telephone calls made from the Property during the Guest’s stay. The Guest authorizes the Property Manager to deduct all costs incurred under the terms of this paragraph from the Guest’s security deposit and promptly pay to the Property Manager any such cost over and above the security deposit, unless the Guest (who must be a US resident) has purchased the Insurance policy from VRBO. 7. The Guest, for herself and on behalf of all members of the Guest’s Party, agrees to behave in a proper and responsible manner and shall not create a nuisance to occupants of neighboring properties while renting the property. The Guest assumes responsibility for the behavior and conduct of the Guest’s party pursuant to the terms and conditions of this rental agreement, as if such persons were named as Guests herein. 8. The Guest agrees to indemnify and save harmless the Property Manager from all expenses, claims, losses, actions, damages or liabilities of any description which may in any way relate to or arise from the use of the Property by the Guest or the Guest’s Party, where the Guest or a member of the Guest’s party is responsible for, or has directly or indirectly caused same to arise. 9. Keep the property and all furnishings in good order 10. Only use appliances for their intended uses 11. PETS are permitted only with prior approval and the Pet Addendum must be completed. 12. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the home, daily maid service is not included in the rental rate. 13. Hot Tub: No children under the age of 14 permitted in hot tub without adult supervision. When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. Our housekeepers drain, sanitize, refill and replenish chemicals in all tubs prior to your arrival. DO NOT STAND ON THE HOT TUB COVER. The hot tub cover is for insulation purposes and is not designed to support a person or persons. It will break and you may be charged for replacement. Remember when not using the hot tub, leave cover on so hot tub will stay warm. 14. Fireplaces: The fireplaces are non-vented propane gas log fired fireboxes. Please do not throw any paper or other combustible materials in the fireplaces. 15. Basement suite: Use of the basement suite in the house is NOT included in the rental agreement and if there are any tenants in the suite they are NOT to be disturbed. 16. Garage: The use of the personal property of the owner in the garage is NOT included in the rental agreement.
