THIS IS A VACATION RENTAL AGREEMENT UNDER THE SOUTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, PAYMENT OF MONEY, OR TAKING POSSESION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THE PROPERTY FOR A VACATION RENTAL. 1. RESORTQUEST MYRTLE BEACH, LLC DBA WYNDHAM VACATION RENTALS is a property management company (hereinafter the “Agent”) licensed in South Carolina as a real estate agency that rents private homes, condominium units and cottages for their owners. Neither the owner nor the Agent are responsible or liable for any loss of the renter’s personal property, accidents, injury, death or damage of any nature from any cause to the renter (including guest’s, licensees or invitees) or injury or death by acts of nature, beach or ocean conditions, recreational activities or use of communal or private pools and other water features. 2. CHARGES: Please initial:_____________ All reservations are subject to a reservation processing fee equal to 6% of the total rent, applicable taxes, cleaning/linen charges and purchase of a property damage protection insurance policy. All reservations require a payment of fifty percent (50%) of the rental charge before tax and full payment of optional trip cancellation insurance (if purchased) at the time the reservation is made. The remaining balance including rent, taxes, processing fee, cleaning and property damage insurance shall be due thirty (30) days before arrival. Reservations made within thirty (30) days of arrival must be paid in full when the reservation is taken and is a guaranteed reservation. Your reservation becomes a guaranteed reservation upon receipt of your signed rental agreement or once money is paid on your account. NOTE: Tax rates are calculated as of the time of this agreement. Tenant shall be responsible for all applicable taxes according to rates in effect at the time of occupancy. 3. PAYMENTS: Reservations made more than 30 days from the date of arrival may be paid by credit card (Visa, MasterCard, American Express and Discover) or by Debit Card with a Visa or MasterCard logo. Reservations made within thirty (30) days of arrival must be paid in full when the reservation is taken and is a guaranteed reservation. Your first payment is due at the time the reservation is taken. The second payment is due thirty (30) days before the arrival date. Credit card payments MUST be placed on a card held in the same name as the responsible party. INITIAL HERE ______________ to have your final payment charged to your credit card. All payments received will be held in an escrow account at Bank of America on Pine Island Rd, Myrtle Beach, SC 29577. Payments may be deposited in an interest bearing account and any accrued interest disbursed to the Agent. 4. ALL RESERVATION SALES ARE FINAL: If you must cancel your reservation, please call our office immediately. Any changes to dates, switching of properties or cancellations will invoke our cancellation policy. Trip cancellation insurance is available for purchase. 5. CANCELLATION POLICY: Cancellations, changes to dates and switching properties are subject to a 15% cancellation fee. The 15% cancellation fee is calculated on the TOTAL RENT not on the deposit amount. The advance rental deposit is non-refundable within 60 days of the reservation arrival date. Advance rental deposits cannot be transferred from one property to another so if you request a property switch within 60 days of your arrival date you will forfeit the deposit on the property that you are moving the reservation from and will be required to pay a new deposit on the property that you are moving the reservation to. Any reservation with an unpaid balance that fails to pay balance by 11am on the day following the scheduled arrival date shall forfeit all deposits and reservation rights. There shall be no refund of unused days in the event of late arrival or early departure. If the Agent cancels the renter’s reservation, the sole responsibility shall be to refund the renter’s deposit or prorated portion. RESPONSIBLE PARTY: The person in whose name the property is reserved will be held responsible for all occupants complying with rental policies, procedures and restrictions. Aside from normal wear and tear, the responsible party will pay the Agent for any damages to the property or its contents during your vacation residency. The responsible party shall be at least 25 years of age and is required to occupy the property for the entire time reserved. 7. RENTAL CAPACITY & AGE RESTRICTION: The MAXIMUM number of occupants that are allowed in a property is noted on page 1 of this agreement. Maximum occupancy includes children and infants in cribs and visitors. Over occupancy in any property is a fire hazard and you may be subject to eviction without refund. All occupants other than families are considered groups in which all occupants are required to be 25 years of age or older. For the purpose of this agreement a family is considered to be a parent or parents or partners and their biological or legally adopted children and other immediate family members. We DO NOT allow groups of college students, graduating high school students, or any other group, supervised or unsupervised outside of our age restriction policy for any reason at any time. If occupants are found to be in violation of this policy they will be evicted without refund. CHECK-IN, CHECK-OUT AND LATE CHECK-IN: PLEASE INITIAL__________________ CHECK-IN: CHECK-IN IS 4:00PM OR LATER – EARLY CHECK-IN IS NOT ALLOWED – PLEASE PLAN ACCORDINGLY. For your convenience we offer keyless entry or an on-site key delivery provision. It is your responsibility to call the rental office on your scheduled arrival day to receive check-in instructions for your property. Please understand that you may not go to the property prior to check-in time so that housekeeping and maintenance can prepare the property for your arrival without interruption. Your arrival at the property before the check-in time may delay cleaning or maintenance and cause a later occupancy time. YOU MAY NOT PARK AT OR ENTER THE PROPERTY FOR ANY REASON UNTIL IT HAS BEEN RELEASED FOR OCCUPANCY BY OUR INSPECTORS. CHECK-OUT: You must vacate the property no later than 10:00am on your scheduled departure date. All keys or card keys, pool cards, passes or badges, gate passes or any other device for access must be returned to the office or placed back at the designated area per the instructions on your property information sheet provided on arrival. We will charge a fee for lost keys, cards or other access devices up to $50 to your credit card LATE CHECK-IN: Our office closes at 5:00pm on weekdays and Saturday and at 1:00pm on Sunday. Please call the rental office on your scheduled arrival day before closing to receive check-in instructions for your property. 9. PROPERTIES ARE PRIVATLY OWNED: The properties managed by the Agent are privately owned and reflect the needs and tastes of the owner. The conditions of the property, as well as the furnishings will vary according to the owner’s desires. All electronics and kitchen equipment is provided by the individual homeowner – we cannot add televisions or other electronics, kitchen equipment, cable channels or internet service to properties where it has not been provided by the owner. Every effort has been made to assure that the descriptions of the properties are correct; however, we cannot be responsible for changes made by the owner to the furnishings, equipment or services in the properties. There will be no refunds due to the property not being decorated or accommodated to your personal taste or due to minor discrepancies on the web site. DO NOT REARRANGE FURNITURE OR ELECTRONICS. DO NOT REMOVE ANY FURNISHINGS FROM INSIDE THE PROPERTY TO USE OUTSIDE FOR ANY REASON. 10. EQUIPMENT FAILURE, HOUSEKEEPING AND OTHER INCONVENIENCES: All advertised equipment in the property should be in working order. Please report any equipment problems to the office immediately. Every effort will be made to correct the problem but we cannot refund money due to mechanical failure. Please be patient if you encounter any inconveniences. We will be as responsive as possible and make every effort to correct situations that are within our control in a timely manner but please understand that we do not employ electricians, HVAC technicians or plumbers and it may take some time to get one on site to take care of the problem. Failure of televisions, dvd players, vcr’s, stereo’s, wireless internet routers, game consoles, jetted tubs, ice makers, HVAC and appliances; outages of power, cable, internet or phone; construction near the property, ants, palmetto bugs and other wildlife in or outside the property; failure or closure of pools, hot tubs and other water features; conditions of buildings or facilities that we do not manage; bad weather or beach conditions are all items that we consider to be beyond our control and will not warrant a refund if they occur. We will do our best to ensure that the property is cleaned properly and sanitized prior to your arrival. If you are not satisfied with the housekeeping upon arrival please notify the office immediately. No refunds will be given for housekeeping not done to your satisfaction but every effort will be made to accommodate your needs. DAMAGE: Each reservation includes a basic insurance policy that will cover accidental damage up to $500 provided the damage is reported to the Agent at the time it occurs – any damage not reported will be considered intentional and will be charged to your credit card. A Visa, MasterCard, Discover or American Express number is required for each reservation and all costs for intentional damage, accidental damages exceeding $500, missing items(including video games, controllers, DVD’s, books, remote controls, towels, linens and beach towels) and excessive cleaning will be charged to the card on file. Damaged, stained or missing linens/towels/bedding will also be charged to you. A fee for a general departure cleaning and linen service has been added to your reservation. Upon departure, tenants are required to wash all dishes, collect trash and remove to trash chute, outdoor trash container or dumpster (specific instructions will be on your property information sheet). Excessive cleaning, including extra cleaning of washer/dryer (make sure you shake all sand out of beach towels and clothing before washing), damaged or missing items and trash left behind will result in additional charges being charged to your credit card. There will be a minimum of $25 fine if trash has to be removed from inside the property. ALL PROPERTIES ARE NON-SMOKING. If evidence of smoking is found inside the property after you check out you will be charged a $300 smoke removal fee. NUMBER OF CARS: Please be aware that most complexes and communities may have strict rules regarding the number of vehicles at a property. Some areas and complexes may not allow motorcycles, trailers, RV’s or car-top carriers and properties with parking decks have height restrictions. Vehicle restrictions may be found on page 1 of this rental agreement. SUBSTITUTION: We reserve the right to substitute accommodations if circumstances require. Circumstances include but are not limited to acts of nature or other accidents that render the property uninhabitable. In the event that your chosen property becomes unavailable, Agent will attempt to contact tenant to offer alternative properties or offer a refund. 14. PAY PER VIEW TELEVISION AND LONG DISTANCE CALLS: Some properties are equipped with extended cable options for your entertainment – pay per view channels and sporting events are absolutely not included in the rental and if ordered will be charged to your credit card. If equipped, there are no additional charges for NetFlix. Some properties are equipped with land line telephones for local calls only (unless noted otherwise in the property description and no long distance calls are to be charged to the line. 15. ITEMS LEFT IN PROPERTY: Agent is not responsible for personal property left in rental properties. 16. OWNER CLOSETS OR OTHER LOCKED AREAS: Any locked closet or other area reserved for the storage of owner’s private property are absolutely not included in the rental and are strictly off limits. RIGHT OF ENTRY: From time to time it may be necessary for the Agent to enter the property during reasonable hours for any purpose connected with the repair, care or management of the property without prior permission from the tenant. (see item #27) 18. WHAT IS PROVIDED AT THE PROPERTY UPON ARRIVAL: All properties are set up for light housekeeping including linens and towels. We provide a STARTER SET of toilet paper, bath soap, shampoo, conditioner, lotion, facial tissue, paper towels, dishwasher detergent and trash bags – enough for a night or two. You should plan to bring a supply of these items from home or plan on purchasing them once you arrive. There is NO daily housekeeping in any of our properties. We provide linens for all beds and sleeper sofa’s and a towel package consisting of two (2) bath towels, one (1) wash cloths and one (1) hand towel per person that the property sleeps. We cannot provide extra linens or towels so if the supply is not going to be adequate please plan to bring extras from home. Most properties are equipped with a washer and dryer or have a laundry facility nearby. 19. PETS: PLEASE INITIAL___________________ No Pets are allowed in any property or outside of any property or on the premises of any property at any time for any reason unless specified in the property description and tenant in in possession of express written permission from the Agent. Violation of this policy will result in eviction without refund and occur additional cleaning and pest control fees. 20. TOWN ORDINANCES: Tenant agrees to abide by all town ordinances, follow all posted beach laws and follow the express instructions of law enforcement representatives conducting public safety measures and evacuations. Tenant will not enter any waters deemed unsafe or with posted signs indicating that they are closed or by instruction of life guards or law enforcement representatives. Occupancy of the property and use of the premises, common areas and public lands shall not be used in any manner as which to disturb any other guest, resident or wildlife. Towels, banners and flags may not be hung from balcony railings, windows or any other area visible from the exterior of any property. Fireworks are illegal to discharge and may not be discharged from any property or on any premises managed by Agent. Alcohol is not allowed in any public place, visible or otherwise. Agent is not responsible for tenant’s prosecution for any violation of any law or ordinance. 21. DISBURSMENT OF FUNDS TO THIRD PARTIES: Tenant authorizes Agent to disburse prior to tenant’s occupancy of the property any portion of pre-paid funds to third parties to pay for any goods, services or benefits procured by Agent for the benefit of the tenant. 22. TENANT DUTIES: Tenant agrees to comply with all obligations imposed by the South Carolina Vacation Rentals Act on the tenant with respect to maintenance of the property, included but not limited to keeping the property as clean and as safe as the conditions of the property permit and causing no unsafe or unsanitary conditions in the common areas and the remainder of the property that tenant uses. Tenant agrees not to use the property for any activity or purpose that violates any criminal law or government regulation. Tenant’s breach of any duty contained in the paragraph shall be considered material and shall result in the termination of tenancy. Tenant shall not smoke inside the property. 23. AGENTS DUTIES: Agent agrees to provide the property in a fit and habitable condition. If at the time tenant is to begin occupancy of the property Agent cannot provide the property in a fit and habitable condition or substitute a reasonably comparable property in such condition, Agent shall refund to tenant all payments made by tenant. Agent shall conduct all brokerage activities in regard to this Agreement without respect to race, color, religion, sex, national origin, handicap, sexual orientation, or familial status of any tenant. If the owner voluntarily transfers the property, tenant has the right to enforce this Agreement against the grantee of the property. If tenant’s occupancy under this agreement is to end 180 days after such recordation, tenant has no right to enforce the terms of this Agreement unless the grantee agrees in writing to honor this Agreement. If the grantee does not honor this Agreement, tenant is entitled to a refund of all advance rent paid by tenant (and other fees owed to third parties not already lawfully disbursed). Within 10 days after the transfer of the transfer of the property, the grantee or the grantee’s agent is required to (i) notify tenant in writing of the transfer of the property, the grantee’s name, address and the date the grantee’s interest was recorded; and (ii) advise tenant whether tenant has the right to occupy the property subject to the terms of this Agreement or receive a full refund of any payment made by tenant. 2.) Upon termination of the owner’s interest in the property, whether by sale, assignment, death, appointment of a receiver or otherwise, the owner, owner’s Agent, or a real estate agent is required to transfer all advance rent paid by tenant (and other fees owed to third parties not already lawfully disbursed) to the owner’s successor-in-interest within 30 days and notify tenant by mail of such transfer and of the transferee’s name and address. However, if tenant’s occupancy under this agreement is to end more than 180 days after the recordation of the interest of the owner’s successor-in-interest in the property, and the successor-in-interest has not agreed to honor this Agreement, all advance rent paid by tenant (and other fees owed to third parties not already lawfully disbursed) must be transferred to the tenant within 30 days. 3.) If the Owner’s interest in the property is involuntarily transferred prior to tenant’s occupancy of the property, the owner is required to refund to tenant all advance rent paid by tenant (and other fees owed to third parties not already lawfully disbursed) within 60 days of transfer. 25. MANDATORY EVACUATION: If state or local authorities order a mandatory evacuation of an area that included the property, tenant shall comply with the order. Upon compliance, tenant will be entitled to a refund of the prorated rent for each night that the tenant is unable to occupy the property because of the order However, tenant will not be entitled to a refund if, prior to taking possession of the property, (i) tenant vacated property during a voluntary evacuation order, or (ii) tenant refused insurance offered by Agent that would have compensated tenant for losses or damages resulting from the loss of use of the property due to a mandatory evacuation order, or (iii) tenant purchased insurance offered by the Agent. The insurance offered shall be provided by an insurance company duly authorized by the South Carolina Department of Insurance and the cost of the insurance shall not exceed eight percent (8%) of the total rent charged for the vacation rental to the tenant. 26. EXPEDITED EVICTION: If the tenancy created hereunder is for 30 days or less the expedited eviction procedures set forth in the Vacation Rental Act. Tenant may be evicted under such procedures if tenant (i) holds over in possession after tenant’s tenancy has expired, (ii) commits a material breach of any provision of the Agreement (including any addendum hereto) that according to its terms would result in the termination of tenant’s tenancy; (iii) fails to pay rent as required by the Agreement; or (iv) has obtained possession of the property by fraud or misrepresentation. INDEMNIFICATION AND HOLD HARMLESS: RIGHT OF ENTRY; ASSIGNMENT: Tenant agrees to indemnify and hold harmless Agent and Owner from and against any liability for personal injury or property damage sustained by any person (including tenant’s guests) as a result of any cause, unless caused by the negligent or willful act of Agent or Owner or the failure of Agent or Owner to comply with the Vacation Rental Act. Tenant agrees that Agent, the owner or their representative may enter the property during reasonable hours to inspect the property, to make such repairs, alterations and improvements thereto as Agent or Owner may deem appropriate, or to show the property to prospective purchasers or tenants. Tenant shall not assign this Agreement or sublet the property in whole or part without express written permission of Agent. I will not bring a pet to a property unless I am at all times in possession of express written permission to do so by the Agent. I authorize the use of my credit card for any damages incurred during my tenancy and agree not to dispute such charges. I understand that my writing on the contract other than where specified for my signature or initials will render the entire agreement null and void.
