The property, its fixtures, furnishings and appliances are in good and undamaged condition and thoroughly cleaned plus providing that all house keys; including the mail box keys, and garage door openers, have been returned on the last day of occupancy, and providing that performance has been made by the tenants under the agreement. Tenant should give the managing members a minimum of 4 hour notice of intent to vacate the property after having met the terms of occupancy per this contract. When vacating the property the tenants will need to check out by 12:00 noon.
*I/We understand that sub-leasing of this property is not allowed by this agreement under any condition. If you have others there's an additional $25 a night fee per person. If other guests are living on the premises, without approval, not paying or named on the contract, the tenant will be liable for their guest rent the entire time. We the managing members, will detect and verify additional tenants, for as long as the guest lives on the premises with contracted Tenants. Payment for that unapproved guest will be due immediately. If not paid the guest must vacate the premises.
I/We agree that there shall be no additions, alterations, painting, installing of items or other changes to the property that would leave damage when removed unless approved in advance with the owner. In addition, lessee shall pay for any additional damages, on inspection of the house. Under no circumstances shall a tenant make any repairs or tinker with the electrical work, or plumbing, what so ever! No pit bulls or large dangerous dogs allowed in this Community, or on the premises, due to liability reasons.
I/We understand that the tenant is responsible for their trash removal. Trash day is Wednesday, must put the trash can's out on the street curb Tuesday night. After pickup please return the trash cans to their proper place.
I/We agree to use reasonable diligence in the care and protection of the said property, and to keep it free of rubbish. Long term lessee will need to take care for the landscaping including in the front of the house, such as watering 2 x a week, from time to time. The Managing Members will provide all other landscaping such as, bug spraying monthly, fertilizing, leaf removal and trimming the trees. In addition, the Managing Members will perform monthly pest control spraying for the outside.
The Managing Members agree to make the necessary repairs to the property, provided that the cause of damage or necessity of repairs is not due to the negligence or deliberate action of the tenant or guests. If found to be negligence then the tenant is responsible for paying to have all broken issues, damaged items fixed. Notify the Managing Members/ within 2 hours, so we have time to make arrangements with repair companies to fix any problems, you are having.
I/We the tenants, further agree to pay all, attorney fees, court costs, and collection fees, which result from non-payment of rent, evictions, and/or damage to the property due to neglect, misuse, or deliberate damage to the property, including carpet and repainting, due to damages.
Iterms on the property at time of rental and condition at that time: Air conditioner, new appliances, heating fireplace, Electrical, Kitchen Cabinets, Plumbing, and Window shades, and Microwave. Any items removed from the property, are considered theft, and punishable by law. Please enjoy the property and leave it in the same shape you find it, cleaned and ready for the next guest.
Stove, oven, air conditioners/heaters, hot water heater, refrigerator, disposal, fireplace, dishwasher, ceiling fans, Washer & dryer, are in good operating condition. Managing Property Managers are responsible for maintenance of all appliances, unless, it's determined, that the appliance has been maliciously or intentional damages by guest.
Animals/Pets No Pets! If found out the guest have unauthorized pets, There's a non refundable Pet charge of $200, per pet, in addition to your room fees. .
Right of Inspection & Access
I/We agree that the Managing Members have reserved the right to inspect the property at any time during the rental period.
I/We hereby give permission to the owners to enter and to show or inspect the property when the tenant is not present within 24 hours prior notification to the tenant. The managing members, have the right to inspect and maintain/repair premises with reasonable notice to tenant. They also, have the right to install fencing, fountains, sidewalks, shrubs, trees, plants and retainer walls to enhance the grounds.
Holdover by Tenant
Usually, in cases where guest do not move out on time, the managing members are permitted by law to charge for another day rent, plus additional fees, until guest are totally checked-out.
INDEMNIFICATION: The LESSEE shall occupy the leased premises at LESSEE'S own risk and shall indemnify LESSOR against all or any Legal expense, loss, cost, damage, claim, action or liability paid, or Court cost, suffered or incurred as a result of any breach by LESSEE, Lessee's agent, servants, employees, visitors or licensees of any covenant or condition of this lease, or as a result of Lessee's use or occupancy of the leased premises, for any illegal under cover operations, or carelessness, negligence or improper conduct of LESSEE, Lessee's agents, servants, employees, visitors or licensees. Must carry Renters insurance.

The property is basically in great condition, at this time. As stated, the Managing Members shall do whatever is fair, and within reason, to make and keep the property in excellent condition, for the tenants on this contract, providing there's no deliberate damages to this property.. Tenants must abide by all HOA Managing laws. Water shrubs and no trash cans left out after the trash has been picked up on Wednesday,. Trash cans must be placed on the side of the house, or behind the Vynal screen at the Apt A area. Not visible in front of the home. All trash can containers must have a lid cover.
WE, reserve the right to prosecute anyone that removes furniture, linens, TV, Internet equipment, or other items from the property they are leasing.
I/We hereby have read the entire contents of this agreement, and understand and approve of the terms. By the signature heron, I/We acknowledge that a signed copy was received.
