Damage and incidentals
You will be responsible for any damage to the rental property that is caused by you or your party during your stay.

- Rental Terms: 1. 50% deposit is required to secure booking. Final payment is due 30 days prior to arrival date. Cancellation policy is as follows: A) Cancellations received at least 60 days before the start of the stay will receive 100% refund B) Cancellations received at least 30 days before start of the stay will receive a 50% refund C) Cancellations received at least 14 days prior to the stay will receive a 25% refund If we are able to re-book the cancelled dates to another client then you may either take a full refund of all funds paid (minus a $75 processing fee) or apply the full amount to any future rental at any time. 2. Movie rentals will be charged to your credit card. There will be a $3.00 per movie surcharge added to the movie cost. 3. Local and long distance phone calls are free within the continental U.S.A. Out-of-area and international long-distance calls will be billed to your credit card. There will be a 50 cent per call charge added to the actual cost of the call. A phone bill will be provided upon request. 4. The property will not be occupied by more people than we have specified in this agreement. 5 . You will not allow dogs, cats, or other pets onto the property at any time. If we find evidence that a pet has been brought into the home, there will be an automatic $500 damage deposit assessment. 6. Smoking is not permitted inside the house. Evidence of smoking inside the home will result in a $500 damage deposit assessment. 7. Barbecue grilling is permitted on the rear deck. Please take extreme care and follow all instructions as to proper and safe usage of the grill. Use of the grill is at your own risk. You will be held solely responsible for any damage to the home/deck/surrounding areas or fire that may result from use of the grill. Use of propane involves risk of fire, explosion and serious injury. By using the grill you agree to indemnify owner of the home from any liability for injury or death related to its use. 8. Neither you nor your guests will use illegal drugs on or in the vicinity of the property. Immediate eviction will result. 9. You will take care not to play excessively loud music or otherwise create a nuisance to the neighbors. 10. The house will be clean when you arrive, and we request that you leave it in good order. You will notify us promptly of any damage or problems that arise. 11. Unless there’s an emergency, we will notify you 24 hours in advance prior to entering the property during your rental period. 12. Violation of any of these rules may result in the tenant’s eviction from the property, as well as an assessment of up to $1000 plus actual damages on the credit card held for the damage deposit. Should the tenant be evicted due to a violation of this agreement, there will be no refunds of any kind. 13. The months of May through November are turtle nesting season. During this time, no lights of any kind are allowed in the vicinity of the beach at night by Volusia County law. Please read the detailed information posted on the refrigerator when you arrive at the home. Failure to obey this law can result in a fine of up to $10,000. Payment of this fine will be the sole responsibility of the tenant. PLEASE LEAVE THE OUTSIDE LIGHTS OFF AT NIGHT AND ADJUST THE BLINDS OR CURTAINS AS NEEDED TO KEEP LIGHT OFF THE DUNES. 14. Renters and all their family and guests using the property waive all rights to litigation in the event of any injuries sustained inside or around the grounds of the property. Any claims for personal injury or property damage will require settlement through binding arbitration. Arbitrator will be selected by property owner and will be licensed either in the state of Florida or New York, and will take place at a location chosen by property owner. Decisions of such arbitrator will be final and binding on both parties. 15. Renters must abide by all Association pool rules as posted. No glass containers are allowed, no unsupervised minors and no unruly behavior will be allowed at any time. Violation of Association Pool Rules may result in loss of pool privileges. 16. Association rules allow only 2 cars to be parked in front of the home at any time. Additional parking is available in our garage for one vehicle. Additional vehicles may be parked by the dumpsters at the entrance, or on the grass on the main road. Report of more than 2 cars in front of the home will result in a $25/day/vehicle charge assessed to your credit card.
