PHONE: The phone is for local and direct dialled long distance calls within USA and Canada. Any international or overseas calls placed or collect calls accepted as well as directory assistance charges will be charged back to the tenant. Emergency medical and police service can be called by dialling 911. CONDITION-DEPOSIT: The Tenants shall maintain the premises in a good and clean condition and use the premises only in a careful and lawful manner. Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The Tenants agree that the Landlord shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings. TRASH: The Tenants shall dispose of all waste material generated during the rental period in a lawful manner and put the trash in the bins provided by the complex. DAMAGE: The Tenants shall pay for any damage done to the premises over and above normal wear and tear. KEYS: The Landlord shall provide the Tenant with keys to the unit, laundry, tennis courts, mailbox and common areas. The Tenant will be charged for replacement if any of the keys are not returned upon departure. NO PETS: No animals or pets will be brought onto the premise without permission from the Landlord. NO SUBLET: The Tenants shall not sublet the property. 4 PEOPLE MAXIMUM: The Tenants shall have no more than 4 (four) persons reside or sleep in the premises. BEHAVIOUR: The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. Quiet hour starts at 10 PM and pool and outdoor noise should be kept to a minimum. NO SMOKING: There shall be no smoking inside the premises. Smoking is permitted on the patio and in designated areas on the common grounds. CONSUMABLES: Landlord shall provide towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by the Landlord’s family. Toilet paper, soap, dish detergent, laundry soap, shampoos, and other consumables are to be purchased by the Tennant. No reimbursement will be made for unused consumables left at the premises. If consumables exist at the premises when the Tenant arrives the Tenant is free to use them. INDEMNIFICATION: The Tenants and Tenants' guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and guests if such coverage is desired. RULES AND REGULATIONS: Tenants agree to abide by all of rules and regulations of Smoketree Racquet Club. The full document of the rules is attached to this agreement. NOT RESIDENCE: Tenants expressly acknowledge and agree that this agreement is for transient occupancy of the property, and that Tenants do not intend to make the property a residence or household. POWER OUTAGES: We occasionally experience outages that are beyond our control. No refunds or compensation will be given for any outages. NO WEATHER OR EMERGENCY REFUNDS: There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions. There shall be no refunds of rents because of shortened stays or ruined expectations due to work and family emergencies or other commitments. SAFETY: It is the Tenant’s responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the pool. Tenant agrees to have responsible adult supervising minors while they swim in the pool. Tenant is hereby notified that the pool can be dangerous and tenant accepts fully the risks involved. FIREARMS: Only legally owned and permitted firearms shall be allowed on the premises according to state and local laws. FIREWORKS: Tenant agrees that fireworks and other hazardous materials shall not be used in or around the property. LEGAL USE: Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc.; shall cause termination of this agreement with no refund of rents or deposits. FIRE EXTINGUISHER: The property has a fire extinguisher located in the kitchen area. The fire extinguisher was fully charged at last inspection. It is the duty of the tenant to inform the Landlord immediately should the fire extinguisher become less than fully charged. Tenant agrees to use the fire extinguisher only for true emergencies. FIRE ALARMS: The property has fire alarms installed and they are believed to function properly at the time of rental. Tennant will notify management without delay if a fire alarm “chirps” or has a low battery condition. NO CARBON MONOXIDE DETECTOR: Tennant is advised that there is no carbon monoxide detector on the property and accepts the risk involved in not having one. SECURITY: Tenant shall see to their own security while in the property by locking doors, windows, etc. when it’s prudent to do so. ARRIVAL NOTIFICATION: Tenant shall notify Landlord of the arrival date and time so arrangements can be made to deliver keys. CHECK-OUT: Tenant shall notify Landlord of their departure time the day before check-out in order to return keys and conduct an inspection if deemed necessary by the Landlord. CABLE TV: Cable TV is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content or personal preferences with regard to cable TV service. INTERNET: High speed internet is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service. AIR/HEAT: Tenant agrees that Air Conditioning shall not be set below 74 degrees and Heat shall not be set above 78, and that the fan setting shall be “Auto”. Doors and windows shall be closed when either heat or air conditioning is in operation. OPERATING RULES AND REGULATIONS FOR SMOKE TREE RACQUET CLUB Adopted November 15, 2006 Parking (CC&R Sections 4.3, 4.4 and 4.11) Vehicles must have current license plates Vehicles must be operable and moved at least once a month No vehicle repairs allowed in the parking lot areas No oversized vehicles (campers, semi-trailer trucks, commercial vehicles) are allowed to be parked on STRC property for longer than 4 hours. Stored vehicles must be parked in the overflow lot on the southeast corner of the property. No storage of trailers, boats, or campers Shopping carts not allowed to be left in parking areas Window coverings (CC&R Section 4.5) No foil, cardboard, or paper coverings at windows Aesthetic window coverings, as determined by the BoD Patios (CC&R Sections 1.17, 4.7, 4.8, 4.14, 5.1, 8.1) Patios cannot be unsightly, disorderly, or unkempt as determined by the BoD No fence extensions into common property No personal landscaping or lighting on common property adjacent to patios No personal items beyond patio edge, into common area External storage units visible from the common area not allowed on patios No clothesline hangings or draped items visible on patio areas Patio sunshades must be aesthetic and in good repair, and approved by the BoD Pets (CC&R Section 4.2) Dogs must be on leas

We are Oregonians that we’re looking for a great spot to soak up the sun during the month of November. Our VRBO was like a home away from home and the owner is great to work with.

Can't Wait to Come Back

We were lucky enough to spend last winter at this wonderful condo. It is probably the best equipped condo we've ever stayed in. From the fully stocked kitchen to the great linens it has virtually everything you need for a short or long stay. The condo is very roomy and Brian couldn't be a better host. He is super responsive and tries very hard to make your stay better. The view from the deck is terrific and we loved walking and biking around the great safe neighborhoods surrounding the condo. The Smoketree is a very friendly community with lots of nice people and activities and a great pool. Just across the street are numerous restaurants and shops, including one of the best hardware stores anywhere, and a nice Ralph's grocery store. Out front is a bus stop for the Thursday through Saturday Buzz Bus, a free service that takes you anywhere in Palm Springs you'd likely want to go and runs every 20 minutes. In short, a great condo in a fabulous location with a wonderful host. We can't wait to return.

ANOTHER ENJOYABLE STAY

This is the 2nd time that we stayed at Brian's condo in the last 3 years. Dealing with Brian has been great, he's very responsive to any questions and very helpful. Condo is very clean, fully equipped for anything you want to cook. The pool and grounds are very spacious and very well maintained. I bring my mountain bike with me and I like the fact that the complex has a bike lockup room for secure storage. We also love the fact that across the street and within a few blocks are a supermarket, restaurants, banks, hardware store, drug store etc. Overall, we totally enjoyed our 2 stays here and plan on returning to this complex (hopefully Brian's place) Thank you again for another amazing stay.

Great place to hangout in Palm Springs!

The property is very nice and very well taken care of. The condo has everything you need, its like being at home. From the large spacious bedroom with ample storage with plenty of linens to the well equipped kitchen, and large living area with flat screen tv. The patio is large and has a good little barbeque. The compound is very nice with a large hot tub and a pool that is great for some lap swimming. There is tennis courts available but it wasn't my racquet but pickle ball is big in the morning. Don't forget Palm Springs is a golf mecca! DS

Amazing location, great experience

We rented for 3 months while on a contract in Rancho Mirage and had an amazing time. The unit is clean and very well appointed with anything you could need for your stay. Brian was very responsive to any needs and responded promptly to any emails. The complex is fantastic, great heated pool and hot tub with orange and lemon trees to pick from when in season. Can't say enough good things about our experience.

Highly recommended, would stay again.

Out of all VRBO's i've stayed at, this one has definitely been my favourite. It was very clean, practical and well stocked. I brought a few extra items with me (as ones i've stayed at in the past have been very limited on items) and turns out he had everything I needed. The grounds and pool were very nice and well maintained which made it even more enjoyable. The location is perfect and very close to everything including a grocery store, restaurants and public transport service. I would highly recommend this place and will be looking forward to returning in the future.

Great suite, great location, great complex

I had the pleasure of staying in this lovely suite. It is nicely appointed and has everything you need. The owner is great to work with and was prompt with replies. I look forward to my return.
