# RULES AND REGULATIONS
**Exploitation en Meublé de Tourisme – Code du Tourisme Art. L324-2 et seq.**

### 1. LEGAL FRAMEWORK AND RIGHT OF ACCESS

This contract is governed by the Civil Code (Art. 1101 et seq.) and the Tourism Code. By virtue of Article 544 of the Civil Code, the owner defines the conditions of use of his property.

* **Restricted access:** Only persons identified at the time of booking are allowed to enter the building and the accommodation. The introduction of undeclared third parties constitutes an immediate breach of contract.
* **Respect for the home:** The tenant has possession of the premises, but undertakes to give access to the owner or his agents in the event of a technical emergency or suspicion of danger.

### 2. FIRE SAFETY AND CAPACITY

This section is imperative for the maintenance of insurance guarantees (Art. L113-2 of the Insurance Code).

* **Limitation of the number of people:** The capacity is strictly limited to **2 people**. The building is sized for a total workforce of less than 15 people so as not to fall under the ERP (Establishments Receiving the Public) regime.
* **Beds prohibited:** Only fixed bedding is intended for sleep. The use of the sofa or additional devices (inflatable mattresses, etc.) for overnight stays is strictly prohibited.
* **Safety organs:** It is strictly forbidden to obstruct, cover or remove the batteries of the **Autonomous Smoke Detectors (DAAF)**. Any improper handling will be charged **150 €** and reported as endangering others.
* **Fire extinguishers:** A **6 kg ABC powder fire extinguisher** is available. Its use not justified by the start of a fire will be subject to a compliance invoice of **200 €**.

### 3. TECHNICAL SPECIFICATIONS OF THE FURNITURE

In accordance with the development standards:

* **Sanitary facilities :** The dimensions of the shower area meet the standards of compact construction. The access has a nominal width of .
* **Mechanical resistance :** Furniture and bedding comply with static resistance standards for standard residential use. Users whose physical characteristics exceed these mechanical resistance thresholds assume responsibility for any damage to the structures.

### 4. NUISANCES AND ENVIRONMENT

* **Zero Tobacco Policy:** In application of contractual freedom, smoking and vaping are absolutely prohibited in the entire home, including windows.
* **Public tranquillity:** The rest of the area is protected by article **R1334-31 of the Public Health Code**. No emerging noise (music, shouting, moving furniture) will be tolerated between **10:00 p.m. and 8:00 a.m.**.
* **Illegal activities:** The use of the premises for prostitution (Art. 225-5 of the Criminal Code) or the consumption of narcotics (Art. L3421-1 of the CSP) leads to immediate denunciation to the judicial authorities and expulsion without notice.

### 5. ENERGY AND FLUID MANAGEMENT

* **Eco-responsibility :** The heating is regulated to ensure a comfortable temperature of to .
* **Overconsumption:** Any electricity or water consumption exceeding the reference thresholds for seasonal residential use by **30%** (established by the metering indexes) will be subject to additional invoicing at the supplier's actual rate, increased by **15%** for management costs.

### 6. LOGISTICS AND PENALTIES

* **Check-out:** The cut-off time is **10:00**. The accommodation must be returned in a correct state of cleanliness, dishes washed and rubbish removed.
* **Late occupancy allowances :** * Delay not allowed: **€50** per hour started.
* Beyond 3 hours of delay: Invoicing of an additional night at twice the rate in force, without prejudice to damages for operating loss (Art. 1231-1 of the Civil Code).


* **Deodorisation costs :** In the event of residual tobacco odour, a cleaning fee by ozone nebulisation of **250 €** will be charged.

### 7. LITIGATION AND COLLECTION

* **Right of retention:** The security deposit covers the aforementioned damage and penalties.
* **Application fees:** Any dispute requiring administrative intervention or arbitration via the booking platform will incur a case management fee of **10%** of the amount of the dispute (minimum **€100**).
* **Jurisdictional jurisdiction :** In the absence of an amicable agreement, the courts within the jurisdiction of the building have sole jurisdiction.
