I wish to swim at the pool or hot tub during the length of stay at your vacation home. By swimming in the vacation home pool and/or hot tub, I recognize and fully understand certain things, including:
•At no time is there a lifeguard on duty, you (the guest) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay.
•My use of the pool facilities during my stay involves certain risks, including but not limited to: 1. The risk of injury resulting from possible malfunction of the pool equipment 2. The risk of injuries resulting from tripping or falling over obstacles in the pool area 3. The risk of injuries resulting from unsupervised divers and swimmers colliding 4. The risk of other injuries resulting from participating in any action in the pool.
•I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming. In exchange for the Owner allowing me to utilize the pool and area during my stay, I hereby agree to the conditions below.
I fully intend and choose to give up the legal rights, as stated below:
1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the “Releasees”) relating to my use of the pool and pool area.
2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES.
3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area.
4. That I am over the age of 18 and that I am responsible and will adhere to all the rules of the property.
5. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate. I have read and understood this document. I am waiving certain legal rights that I may have against the Releasees, and I fully agree to do so.
-The jets in the master bathroom tub do not work.
-Pool is not heated, but pool heat is available when requested at time of booking AND paid for before arrival. Pool heat is $50 per day plus tax. Pool heat must be paid prior to arrival and for your entire stay.
-This home does not have cable TV. You will only be able to watch streaming apps by logging in to your own streaming accounts.
-No smoking or vaping, no pets, and no events allowed.
-Guests must be 25 years of age or older to rent and are required to email a photo ID at the time of booking. The guest making the reservation must also be present for the duration of the stay.
-Third party bookings are NOT allowed.
-A rental agreement must be signed to confirm your reservation. If the agreement is not signed and the reservation is not paid in full, you will not receive the arrival information. Provided all requirements are met, the arrival details will be emailed 7 days prior to your scheduled arrival.
-Check-in is anytime after 4 PM Central Time. You may request an early arrival for an additional fee; however, please note that it is not guaranteed, as it depends on the availability of the unit after morning check-outs and the cleaning & inspection schedule. If you require an early arrival, you may consider booking for the night prior.
-Check-out is strictly at 10 AM Central Time. Any departure after this time will result in an additional fee.
-Quiet hours are 10pm to 7am per the Bay County Noise Ordinance
-Please understand that Florida's natural environment includes bugs, insects, ants, mosquitoes, and spiders. We perform regular interior and exterior pest control, but keeping doors, windows, and sliders closed will help prevent entry. No refunds will be issued for sightings of bugs or wildlife in or around the property.
-Supplies:
We provide a starter pack of supplies, including 1 roll of toilet paper per bathroom, 1 roll of paper towels, 1 trash bag per trash can, 1 packet of dish detergent and 1 packet of laundry detergent, to get you started. For additional supplies, there are nearby stores. This is meant to get you through your first day or so until you can get to a store.
-By renting this home you acknowledge that you understand you enter and occupy the premises at your own risk and that the homeowner and Sun & Sand Rentals are not and will not be responsible for injuries or deaths that may occur on our property. You, and all of your guests attending, agree that everything you use is at your own risk, including any beach equipment left on the property. By renting this home, you agree that you are also financially responsible for any third party damages that are caused by your group. Neither the homeowner or Sun & Sand Rentals are liable, financially or otherwise, for any accidental or intentional third party damages your party causes.
