GENERAL TERMS AND CONDITIONS OF RENTAL This rental agreement is entered into under the terms and conditions set forth below, which the tenant agrees to comply with, failing which the tenant may be liable for damages and may even result in the termination of this agreement by the landlord, without the tenant being entitled to claim a reduction in rent. The premises are rented for temporary residential and recreational use only, excluding any professional, commercial, or craft-related activity of any kind. The reservation will become effective once the tenant has returned a signed copy of the contract and a signed copy of the general rental terms and conditions, accompanied by payment of a deposit equal to 20% of the total rental price. The balance and the security deposit are to be paid upon handover of the keys. It is agreed that in the event of cancellation: - by the tenant, except in cases of force majeure and upon presentation of supporting documentation: • more than one month before the lease takes effect, the tenant forfeits the deposit paid; • if less than one month before the lease takes effect, the tenant shall also pay the difference between the deposit and the total rent as a penalty clause. - due to the landlord: • within seven days of the cancellation, the landlord is required to pay double the deposit to the tenant. Any cancellation must be notified by recorded delivery. Termination Clause - In the event of failure to pay by the established due dates or in the event of breach of any provision of this agreement, and five clear days after a simple demand by recorded delivery has remained unanswered, this contract shall be immediately terminated, and the landlord may invoke Article 1590 of the Civil Code to retain the deposit paid as initial damages. In the event of early termination of the stay by the tenant, and provided the landlord is not at fault, no refund will be made other than the security deposit. The landlord provides a dwelling in good condition and in accordance with the description. The premises are rented furnished, including kitchen appliances, dishes, glassware, blankets, and pillows. The tenant must act with due care, occupy the premises personally, maintain them, and be liable for any damage that may occur during the stay. Repairs made necessary by negligence or poor maintenance during the rental period shall be the tenant’s responsibility. The tenant is responsible for cleaning, and the property must be returned in a clean condition. The premises must show no damage and must be left clean and in good order (cupboards, trash tins, and refrigerators free of trash; bathrooms; appliances; dishes, etc.). The tenant shall be responsible for any damage or cleaning costs resulting from the presence of their pets. If necessary, the landlord shall be entitled to charge the tenant, upon departure, a cleaning fee set at a flat rate of €50. This lease is entered into under the customary terms and conditions applicable in such matters, and the tenant agrees, in particular, to: - make no alterations whatsoever to the premises or the arrangement of the furniture; - allow the landlord to carry out any repairs that may become urgent or necessary during the lease term, without claiming compensation or a reduction in rent. If the number of tenants exceeds the maximum authorised occupancy, the landlord reserves the right to refuse additional tenants or to charge a surcharge. The tenant is obligated to ensure that the peace and quiet of the area is not disturbed by the tenant or their family. Setting up tents or parking caravans or RVs on the grounds of the rented property is prohibited without the owner’s prior consent. Insurance The tenant agrees to obtain insurance covering rental risks (fire, water damage). The tenant must therefore verify whether their home insurance policy includes “holiday home” coverage or take out a separate policy. Failure to maintain insurance, in the event of a claim, will result in liability for damages. The tenant is required to notify the landlord within 24 hours of any incident occurring in the dwelling, its outbuildings, or ancillary structures. The security deposit will generally be refunded upon departure following the exit inspection, less the total replacement cost of any items, furniture, or equipment that is broken, cracked, chipped, or damaged, as well as items showing wear and tear exceeding what is normal for the duration of the rental. At the latest, it will be returned one month after the tenant’s departure, unless a deduction is made. q) Each party agrees to comply with and honour the terms of this contract.
