Prior documentation is required for assistant animals. Per the HOA:
a. Any resident, whether Owner, tenant, or otherwise, who seeks to keep a Service/Assistance Animal in their Unit must request permission from the Board. The Board will evaluate the request using the criteria set forth in the law and HUD guidance. b. Requesting permission for Service/Assistance Animal: i. Unless such person’s disability-related need for a Service/Assistance Animal is obvious, any person desiring to keep a Service/Assistance Animal in their unit must first provide verification of the disability related need for the animal. A completed “Reasonable Accommodation Request Verification” form must be signed. ii. A completed “Service/Assistance Animal Registration” form must be signed along with the following: 1. Record of up-to-date rabies vaccination (dog only) and license/registration (dog or cat). 2. A clear color photograph of the animal iii. The required documentation may be mailed, scanned/emailed, faxed, or delivered in person to the Association Office. iv. Additional information and/or documentation may be required before the Board makes its decision. c. Responsibilities of Persons with a Service/Assistance Animal: i. All persons with a Service/Assistance Animal are required to abide by any state or local law, as well as the Association’s rules, regarding the care and treatment of the animal. Such requirements include, but are not limited to: WINFIELD PLACE HOMEOWNERS ASSOCIATION 15 1. Dogs and cats must be licensed pursuant to Maricopa County Ordinance. Dogs must have current vaccinations against rabies and wear a rabies vaccination tag. Dog owners must provide proof of current rabies vaccinations when requested by the Association’s manager. 2. Care and supervision of the animal is the sole responsibility of the owner/individual who benefits from the animal`s use. The custodian must always maintain control of the Service/Assistance Animal. The custodian is also responsible for ensuring the clean-up of the animal`s waste. The animal must not be left outside the Unit unattended. 3. The animal must be on a leash, harness, or other tether at all times, when outside the residence unless the individual is unable to use one of those devices because of the disability. In that event, the individual must still maintain control of the animal at all times. 4. The animal must not become a nuisance to others by way of aggressive behavior, incessant barking, fleas, etc. 5. The Board may designate a specific location within the Winfield Place grounds for Service/Assistance Animals to relieve themselves. The caretaker of the Service/Assistance Animal is responsible for removal of the defecation from the property. Failure to do so will result in a cleaning fee charged to the Owner of the Unit. d. Removal of a Service/Assistance Animal: i. The Association may require a Service/Assistance Animal to be removed from the property if the disability-related need for the animal is no longer present. ii. The Association may require a Service/Assistance Animal to be removed from the property if, at the discretion of the Board of Directors, the Service/Assistance Animal poses a direct threat to the health or safety of other individuals or risk of substantial physical damage to the property (including pets) of others. e. Damage: i. The Owners of Units where Service/Assistance Animals reside are responsible to the Association for any damage to areas maintained by the Association caused by a Service/Assistance Animal. f. Exceptions: i. Exceptions to this policy may be considered by the Board of Directors on a case-by-case basis upon request of a resident seeking an accommodation
