The Parties and Property
This Short Term Rental Agreement (“Agreement”), intended for rentals for no more than 30 days, is a binding contract between Owner and Guest. As used in this Agreement, the term Guest collectively refers to each individual or entity that pays all or any portion of the Rental Fees and all other individuals who occupy the Rental Property. Payment of any portion of the Rental Fees and/or occupation of the Rental Property demonstrates acceptance of the terms and conditions of this Agreement.
The Rental Fee includes any and all costs, expenses, fees or penalties that Property Manager may charge the Guest for their occupancy and use of the Rental Property as described under this Agreement.
Guest must pay Owner a Reservation Deposit at the time the Rental Property is reserved. The Reservation Deposit may be equal to or more than fifty percent (50%) of the total Rental Fee. Reservations and payments arranged through VRBO/Airbnb require that taxes and fees be paid with the first payment. The remaining balance of the Rental Fee is due and payable no later than thirty (30) days before check-in date. Property Manager may cancel the reservation for failure to make timely payments.
Any reservations made less than thirty (30) days prior to the check-in date will require immediate payment of the Rental Fee, and such amount will become non-refundable.
Property Manager accepts: When booking through VRBO or airbnb, all payment MUST be paid through the booking website. No direct payments are accepted. When booking directly the following payments are accepted: Check, cashiers check, Wire. Property manager also accepts credit card payments(Visa, MasterCard, Discover, or American Express) however these payments are subject to an additional 3% to 3.5% credit card fee. No personal checks will be accepted less than fifteen (15) days prior to check-in date. Any personal check returned by the bank will be charged a ($145) dollar fee. If the booking is to be accepted a wire for deposit and or final payment must be sent and accepted with in 48 hours of bounced check. Property Manager will provide instructions on payment.
Reservation Cancellations and Forfeitures
Reservations may be cancelled ONLY by emailing Property Manager, or canceling through the website that the original booking was made per website policy. Cancelation is per website rules at time of booking. When booking directly full refunds are given if cancelation occurs 60 days or more from the date of check in. After 60 days, the dates are non-refundable. However manager will work with you to try to mitigate cancelation fees by attempting to find a replacement guest.
Security Deposit
Prior to Guest checking into the Rental Property, Property Manager a credit card will be held on file as an extra layer of security. Any damages will be billed through vrbo/airbnb for various damages or penalties resulting from violations of this Agreement, as well as any misuse of the Rental Property which includes, without limitation, damage, theft, unauthorized pets, smoking, exceeding occupancy limits, early check-in or late check-out without Property Manager’s prior approval, extensive cleaning required following check-out, damage to Common Areas and Facilities, any fines imposed due to violation of any law, ordinance, rule or regulation by Guest. This will come at the sole discretion of property manager.
Guest Minimum Age
The Guest renting the Rental Property must be at least 18 years old.
Check-In
Check-in is 4:00 pm. You may check-in as early as 10:00 am for an additional fee by contacting Property Manager. This option is subject to availability.
Check-Out
Check-out time is 10:00 am. Upon check-out, Guest must follow the departure instructions posted at the Rental Property. Failure to follow the departure instructions may result in charges to the Security Deposit. If a Guest fails to vacate the Rental Property or remove their personal belongings by the check-out time, penalties may be charged to the Security Deposit. You may check-out as late as 5:30 pm for an additional fee by contacting Property Manager.
Access to Rental Property
Owner and Property Manager may enter the Rental Property for cleaning, repairs, inspection and other needs as deemed necessary during the rental period. The Property Manager will always try to notify Guest prior to each occurrence.
Rental Property Availability
If for any reason the Rental Property becomes unavailable (i.e. unforeseen maintenance or construction), Property Manager reserves the right to cancel the reservation for a full refund. Management will show best effort in transferring the reservation to another comparable property, however cannot guarantee a transfer. All rental funds will be refunded if the reservation is canceled by the owner.
Use of Rental Property
Guest accepts responsibility to properly care for the Rental Property during their occupancy and agrees to: (i) leave the Rental Property in the same condition as when Guest began occupancy except for normal wear and tear, (ii) replace or repair and pay for any breakage, damage, or loss caused by Guest, (iii) be financially responsible for unwarranted or unneeded service calls, or service calls caused by misuse of the Rental Property, (iv) abide by occupancy limits of the Rental Property at all times. Guest agrees not to use the Rental Property, or any Common Areas or Facilities, for any activity or purpose that violates any laws, rules or regulations.
Snow Removal
This home has a heated driveway that is active during winter months. Often when the snow plows come they can create a bump at the end of the driveway. This generally can be navigated easily. If the snow is too much to exit safely please contact management.
Excess Charges
Any noticeable repair or maintenance problems are asked to be brought to Property Manager’s attention within 24 hours of occurrence or occupancy of the Rental Property. Failure to report such matters to Property Manager may result in a delay of mitigating the issue. Guest being held responsible for damages or repairs. Any excessive or unauthorized repair or maintenance expenses incurred by Guest such as unwarranted or unneeded service calls may be charged to the Security Deposit.
Appliances, Equipment and Utilities
Property Manager cannot guarantee against the failure or unavailability of heating, air conditioning, refrigerators, ovens, hot tubs, pools, saunas, TVs, satellite receivers, or other similar appliances or equipment. Likewise, Property Manager cannot guarantee against outages of utility services such as electricity, gas, water, plumbing, cable television, satellite TV or Internet service. Property Manager assumes no responsibility or liability whatsoever for any alleged or actual Guest loss or damage directly or indirectly related to the malfunctioning of any appliances or equipment, or the outage of any utilities. Property Manager will make every reasonable effort to have repairs performed as quickly as possible, but cannot guarantee repair will be completed during Guest’s stay.
In the event of any persistent failure of certain critical major appliances, equipment or utilities that cause the Rental Property to become unsafe or unusable (i.e. heating, major appliances, electricity, gas or water) Property Manager will make every reasonable effort to accommodate Guest in an alternate property and/or provide a reasonable reduction of the Rental Fee as determined by Property Manager. Of course, in the event of widespread utility outages, internet outages, Property Managers options to relocate Guest to a rental property not experiencing the same outages may be limited or even impossible.
Rental Fee Reduction / Refund Policy
Property Manager is under no obligation to provide Guest with any form of compensation, refund or reduction of Rental Fee for the malfunctioning of minor appliances or equipment, or temporary utility outages. Likewise, no compensation, refunds or reduction of Rental Fee will be given for (i) delayed arrivals, (ii) early departures, (iii) reduction in the number of nights reserved less than 30 days prior to
check-in date, (iv) loss, damage or injury to persons or their personal property; (v) weather/road conditions, (vi) natural disasters, (vii) too much snow or not enough snow, or (viii) acts of God or other similar reasons that are beyond Property Manager’s control.
Furnishings
Rental Property furnishings are subject to change without notice. Furniture, bedding, mattress pads or similar furnishings supplied with the Rental Property must not be removed from the Rental Property. Any damage to or loss of these furnishings will result in charges to the Security Deposit. Furnishings must not be moved in any manner that may damage floors or walls, or that would pose any fire or safety hazards.
Parking
Guest is expected to be aware of, and fully comply with such parking rules, regulations or policies. Guest is entitled to three parking spots in the private garage. Neither the Property Manager nor the Owner shall assume any liability or responsibility whatsoever for any damage or costs incurred by any Guest as the result of any vehicle being parked at or near the Rental Property, or being towed. During winter months it is suggested that cars park inside the garage for snow removal on roads, the driveway is heated. The Garage doors must remain closed at all times (when not in use) to deter animals. Though this is a safe neighborhood, it is recommended to keep garage doors closed and personal belongings inside the house.
Pets
Although we love pets, they are prohibited in the Rental Property unless otherwise approved by Property Manager in advance. Any evidence of pets will result in an additional cleaning fee of $1,500.
Smoking Policy
Smoking is STRICTLY FORBIDDEN in the Rental Property. Evidence of smoking in the Rental Property will result in a $2,500 fine.
Fireplaces
The Rental Property includes natural gas burning fireplaces. Guest agrees to (i) make themselves familiar with the location and function of the fire extinguisher (under the kitchen sink), (ii) never leave a fire burning unattended, and (iii) always turn the gas fireplace completely off after using the fireplace.
Use of Special Amenities and Weather Conditions Waiver of Liability
The Rental Property includes a hot tub, this special amenity is not guaranteed to be available or functioning during Guest’s stay. We strive to have clean and fresh water and will do our best to have it warm and ready for each group. At the conclusion of your stay if there is debris, glass or the need to drain mid-stay a $450 fee will occur. Guest is advised that the Rental Property is located in a mountainous and subject to extreme Weather Conditions, which can cause slippery and dangerous conditions.
Guests must comply with any rules and regulations governing the use of the Hot Tub (i.e. hours of use/quiet enjoyment noise restrictions, maximum number of users, consumption of food, use of glass containers, etc.).
Guest understands that special risks may be involved in using the Hot Tub, navigating dangerous Weather Conditions. Guest specifically acknowledges and understands that Weather Conditions may pose danger. Guest agrees to explain the risks of using the Hot Tub and Weather Conditions to their guests/children, and also agrees to be fully and solely responsible for any accidents his/her guests may incur.
Guest understands the risks and agrees that they will assume responsibility for themselves and their guests for the consequences of those risks. Guest agrees to waive any claim whatsoever against the owner of the Rental Property, the condominium or homeowners association, and the Property Manager for any accidents or claims arising from the use of any Special Amenity or Weather Conditions by any Guest. Guest also understands and agrees that they are responsible and liable for any damages that may occur to any Special Amenity/Hot Tub due to their misuse and/or negligence.
Excessive Noise
Guest agrees not to undertake any activities that interfere with their neighbors' right to quiet enjoyment of their property. Guest agrees to fully comply with local noise regulations and to use common sense in keeping noise volume low after dark.
Casualty or Destruction
Should the Rental Property be destroyed or rendered uninhabitable by an Act of God or by any environmental disaster, this Agreement shall become null and void, and Guest will be entitled to a refund of all or a prorated portion of any portion of the Rental Fee that has been paid. In the event of such casualty or destruction, Guest’s sole remedy will be a complete or partial refund of the Rental Fee, as determined by Property Manager. Guests shall not be entitled to any other compensation that may be directly or indirectly related to such casualty or destruction.
Indemnification and Insurance
Guest agrees to indemnify, defend and hold harmless Property Manager and the owner of the Rental Property from and against all loss, claims, liability, damage, expenses, and penalty arising from any action of any Guest which causes injury or death to any person or damage to the Rental Property or any other property.
Succession, Assignment
This Agreement is binding on, and the benefits, responsibilities and liabilities set forth under this Agreement shall inure to, the heirs and personal representatives of the Guest. However, neither this Agreement nor any rights or benefits hereunder may be assigned by any Guest.
Credit Card Authorization
Any Guest who provides any credit card to Property Manager is doing so as a guarantee of payment of all or any portion of the Rental Fee. Each such Guest accepts all terms of this Agreement and accepts complete liability for the payment of any Rental Fees, as well as any damage beyond normal wear and tear during any Guest’s occupancy and use of the Rental Property. Each Guest providing his or her credit card understands that these Rental Fees will be charged to their credit card and hereby authorizes Property Manager to charge their credit card for payment of any such Rental Fees.
Enforcement Fees and Costs, Venue
Should Property Manager be forced to employ legal counsel and/or or professional collection services in order to enforce any provision of this Agreement, Guest shall be responsible for any and all costs associated with such enforcement, eviction or collection matters including, without limitation, reasonable attorneys fees. The venue for any lawsuit, dispute resolution or other legal proceeding related to this Agreement shall be Summit County, Utah.
General Terms
This Agreement shall be governed solely by the laws of the State of Utah without reference to conflicts of law rules. If any section, clause, paragraph or term of this Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect. This Agreement is made in full compliance with federal state and local Fair Housing Laws, without regard to race, color, religion, sex, country of origin, handicap or familial status.
By signing below you agree to the Agreement. You certify that you will be held responsible for the care of this property being rented under your name. You accept full responsibility for damages or extra cleaning charges incurred during your occupancy discovered during or after departure. You understand that if you do not report damages caused during the stay that the damages may not be covered under

Any excessive or unauthorized repair or maintenance expenses incurred by Guest such as unwarranted or unneeded service calls may be charged to the Security Deposit.
Appliances, Equipment and Utilities
Property Manager cannot guarantee against the failure or unavailability of heating, air conditioning, refrigerators, ovens, hot tubs, pools, saunas, TVs, satellite receivers, or other similar appliances or equipment. Likewise, Property Manager cannot guarantee against outages of utility services such as electricity, gas, water, plumbing, cable television, satellite TV or Internet service. Property Manager assumes no responsibility or liability whatsoever for any alleged or actual Guest loss or damage directly or indirectly related to the malfunctioning of any appliances or equipment, or the outage of any utilities. Property Manager will make every reasonable effort to have repairs performed as quickly as possible, but cannot guarantee repair will be completed during Guest’s stay.
In the event of any persistent failure of certain critical major appliances, equipment or utilities that cause the Rental Property to become unsafe or unusable (i.e. heating, major appliances, electricity, gas or water) Property Manager will make every reasonable effort to accommodate Guest in an alternate property and/or provide a reasonable reduction of the Rental Fee as determined by Property Manager. Of course, in the event of widespread utility outages, internet outages, Property Managers options to relocate Guest to a rental property not experiencing the same outages may be limited or even impossible.
Rental Fee Reduction / Refund Policy
Property Manager is under no obligation to provide Guest with any form of compensation, refund or reduction of Rental Fee for the malfunctioning of minor appliances or equipment, or temporary utility outages. Likewise, no compensation, refunds or reduction of Rental Fee will be given for (i) delayed arrivals, (ii) early departures, (iii) reduction in the number of nights reserved less than 30 days prior to
check-in date, (iv) loss, damage or injury to persons or their personal property; (v) weather/road conditions, (vi) natural disasters, (vii) too much snow or not enough snow, or (viii) acts of God or other similar reasons that are beyond Property Manager’s control.
Furnishings
Rental Property furnishings are subject to change without notice. Furniture, bedding, mattress pads or similar furnishings supplied with the Rental Property must not be removed from the Rental Property. Any damage to or loss of these furnishings will result in charges to the Security Deposit. Furnishings must not be moved in any manner that may damage floors or walls, or that would pose any fire or safety hazards.
Parking
Guest is expected to be aware of, and fully comply with such parking rules, regulations or policies. Guest is entitled to three parking spots in the private garage. Neither the Property Manager nor the Owner shall assume any liability or responsibility whatsoever for any damage or costs incurred by any Guest as the result of any vehicle being parked at or near the Rental Property, or being towed. During winter months it is suggested that cars park inside the garage for snow removal on roads, the driveway is heated. The Garage doors must remain closed at all times (when not in use) to deter animals. Though this is a safe neighborhood, it is recommended to keep garage doors closed and personal belongings inside the house.
Pets
Although we love pets, they are prohibited in the Rental Property unless otherwise approved by Property Manager in advance. Any evidence of pets will result in an additional cleaning fee of $1,500.
Smoking Policy
Smoking is STRICTLY FORBIDDEN in the Rental Property. Evidence of smoking in the Rental Property will result in a $2,500 fine.
Fireplaces
The Rental Property includes natural gas burning fireplaces. Guest agrees to (i) make themselves familiar with the location and function of the fire extinguisher (under the kitchen sink), (ii) never leave a fire burning unattended, and (iii) always turn the gas fireplace completely off after using the fireplace.
Use of Special Amenities and Weather Conditions Waiver of Liability
The Rental Property includes a hot tub, this special amenity is not guaranteed to be available or functioning during Guest’s stay. We strive to have clean and fresh water and will do our best to have it warm and ready for each group. At the conclusion of your stay if there is debris, glass or the need to drain mid-stay a $450 fee will occur. Guest is advised that the Rental Property is located in a mountainous and subject to extreme Weather Conditions, which can cause slippery and dangerous conditions.
Guests must comply with any rules and regulations governing the use of the Hot Tub (i.e. hours of use/quiet enjoyment noise restrictions, maximum number of users, consumption of food, use of glass containers, etc.).
Guest understands that special risks may be involved in using the Hot Tub, navigating dangerous Weather Conditions. Guest specifically acknowledges and understands that Weather Conditions may pose danger. Guest agrees to explain the risks of using the Hot Tub and Weather Conditions to their guests/children, and also agrees to be fully and solely responsible for any accidents his/her guests may incur.
Guest understands the risks and agrees that they will assume responsibility for themselves and their guests for the consequences of those risks. Guest agrees to waive any claim whatsoever against the owner of the Rental Property, the condominium or homeowners association, and the Property Manager for any accidents or claims arising from the use of any Special Amenity or Weather Conditions by any Guest. Guest also understands and agrees that they are responsible and liable for any damages that may occur to any Special Amenity/Hot Tub due to their misuse and/or negligence.
Excessive Noise
Guest agrees not to undertake any activities that interfere with their neighbors' right to quiet enjoyment of their property. Guest agrees to fully comply with local noise regulations and to use common sense in keeping noise volume low after dark.
Casualty or Destruction
Should the Rental Property be destroyed or rendered uninhabitable by an Act of God or by any environmental disaster, this Agreement shall become null and void, and Guest will be entitled to a refund of all or a prorated portion of any portion of the Rental Fee that has been paid. In the event of such casualty or destruction, Guest’s sole remedy will be a complete or partial refund of the Rental Fee, as determined by Property Manager. Guests shall not be entitled to any other compensation that may be directly or indirectly related to such casualty or destruction.
Indemnification and Insurance
Guest agrees to indemnify, defend and hold harmless Property Manager and the owner of the Rental Property from and against all loss, claims, liability, damage, expenses, and penalty arising from any action of any Guest which causes injury or death to any person or damage to the Rental Property or any other property.
Succession, Assignment
This Agreement is binding on, and the benefits, responsibilities and liabilities set forth under this Agreement shall inure to, the heirs and personal representatives of the Guest. However, neither this Agreement nor any rights or benefits hereunder may be assigned by any Guest.
Credit Card Authorization
Any Guest who provides any credit card to Property Manager is doing so as a guarantee of payment of all or any portion of the Rental Fee. Each such Guest accepts all terms of this Agreement and accepts complete liability for the payment of any Rental Fees, as well as any damage beyond normal wear and tear during any Guest’s occupancy and use of the Rental Property. Each Guest providing his or her credit card understands that these Rental Fees will be charged to their credit card and hereby authorizes Property Manager to charge their credit card for payment of any such Rental Fees.
Enforcement Fees and Costs, Venue
Should Property Manager be forced to employ legal counsel and/or or professional collection services in order to enforce any provision of this Agreement, Guest shall be responsible for any and all costs associated with such enforcement, eviction or collection matters including, without limitation, reasonable attorneys fees. The venue for any lawsuit, dispute resolution or other legal proceeding related to this Agreement shall be Summit County, Utah.
General Terms
This Agreement shall be governed solely by the laws of the State of Utah without reference to conflicts of law rules. If any section, clause, paragraph or term of this Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect. This Agreement is made in full compliance with federal state and local Fair Housing Laws, without regard to race, color, religion, sex, country of origin, handicap or familial status.
By signing below you agree to the Agreement. You certify that you will be held responsible for the care of this property being rented under your name. You accept full responsibility for damages or extra cleaning charges incurred during your occupancy discovered during or after departure. You understand that if you do not report damages caused during the stay that the damages may not be covered under
